Drug driving offences are a growing area of prosecution in Ireland. They cover both impairment-based charges (where a garda forms an opinion that a driver is impaired) and charges based on the detection of a specified controlled substance above the legal limit, typically confirmed through roadside oral fluid testing followed by a laboratory blood test. These cases often turn on technical and procedural detail: the administration of the roadside test, the handling and testing of the blood sample, and the qualifications of those forming an opinion of impairment.

Gardaí currently test at the roadside for the following drugs using an approved device:

  • Cannabis
  • Amphetamines / Methamphetamines
  • Ketamine
  • Opiates
  • Cocaine

In drug driving prosecutions it is normal procedure for a driver to be detained pending a blood or urine sample being given. You will normally be released pending analysis of the sample. Current practice is for gardaí, once in receipt of a Certificate of Analysis from a State-approved laboratory, to begin the prosecution by way of court summons.
