The law and how I can help
It is an offence to engage or attempt to engage in a sexual act with a child under 15, and separately with a child under 17, under the Criminal Law (Sexual Offences) Act 2006 as amended. A person charged may argue they honestly believed the child was older than the relevant age. It is not a defence that the child consented.
The 2017 Act changed how some cases between young people are treated. I will explain how the law applies to your situation.
Young people close in age
Some cases involve two young people of similar age. The 2017 Act changed how these are approached. The right advice depends on the ages involved and the circumstances, so I look carefully at the facts before explaining where you stand.
Consequences beyond court
A conviction for some sexual offences can carry notification requirements under the Sex Offenders Act 2001. It can also affect Garda vetting, employment, study, travel and reputation.
Even without a prosecution, an allegation can lead to other processes, such as child protection assessments, or action by an employer or school.
Discretion and care
These matters are sensitive. If the person under investigation is young, a parent or guardian is often the first to call. I can explain the process, the person's rights, and what will happen at each stage.
