The law and how I can help

An allegation made in a workplace or public setting can lead to a Garda investigation and to disciplinary or professional processes at the same time. What you say in one can affect the other.

I will advise on the criminal case first, and on how to approach any parallel process so it does not damage your position.

When the allegation arises at work

Your employer may begin its own investigation, suspend you, or ask you to attend a disciplinary meeting, and may also report the matter to the Gardaí. These steps can begin before you have had any chance to take advice.

Two processes, one risk

Anything you say in a workplace process may find its way into the criminal case. I advise you on whether and how to take part, and on timing. An employer's process can continue even if there is no prosecution.

Employment law advice may also be needed. I can advise on the criminal side and work alongside your employment adviser.

Professional bodies

If you are registered with a professional or regulatory body, you may have duties to report an allegation or investigation, or it may be reported to them. I advise on how that interacts with the criminal case.

Allegations in public places

Allegations arising in bars, nightclubs, public transport, events or other public settings often depend on CCTV and the accounts of bystanders. Footage is often overwritten quickly, so early advice can help identify what exists and how it can be requested.

What to do now

  • Do not respond to your employer's investigation without advice.
  • Do not contact the complainant or colleagues about the allegation.
  • Do not post about it on social media.
  • Keep copies of every document and message from your employer.
